Privacy Policy

Your privacy is important to us. This policy explains how we handle your data.

Last updated: July 20, 2026

1. Introduction

Welcome to Brandmek ("we," "our," or "us"). We respect your privacy and are committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you visit our website, interact with our advertising on third-party platforms (such as Facebook and Instagram), or submit your details through one of our forms, and tell you about your privacy rights and how the law protects you.

We handle personal information in accordance with applicable privacy laws, including the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) for individuals in Australia, and the UK/EU General Data Protection Regulation (GDPR) where applicable.

2. Information We Collect

We may collect, use, store, and transfer different kinds of personal data about you which we have grouped together follows:

  • Identity Data: includes first name, last name, username or similar identifier.
  • Contact Data: includes billing address, delivery address, email address, and telephone numbers (which we may use to contact you by phone, SMS, or messaging services such as WhatsApp).
  • Business Data: includes your business name, website URL, industry or business category, and information you provide about your business needs when requesting an audit, quote, or consultation.
  • Technical Data: includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.

  • Marketing and Communications Data: includes your preferences in receiving marketing from us and our third parties and your communication preferences.

3. Lead Forms and Social Media Advertising

We run advertising on platforms operated by Meta Platforms, Inc. and Meta Platforms Ireland Ltd (including Facebook and Instagram). If you respond to one of our advertisements — for example, by completing an "Instant Form" to request a free audit, report, or consultation — we collect the information you submit through that form. This typically includes your name, email address, phone number, website URL, and business details.

Some of this information may be pre-filled by Meta from your social media profile; you can review and edit it before submitting. Your use of Facebook or Instagram is also governed by Meta's own privacy policy, available at facebook.com/privacy/policy. We are not responsible for Meta's handling of your data on their platforms.

When you submit a lead form, we use your details to:

  • Prepare and deliver the audit, report, or other service you requested;
  • Contact you about your request by email, phone, SMS, or WhatsApp;
  • Send you relevant follow-up information about our services, where permitted (see Section 5).

4. Cookies, Analytics, and the Meta Pixel

Our website uses cookies and similar tracking technologies to analyse traffic, improve your experience, and measure the effectiveness of our advertising. This may include:

  • The Meta Pixel: a piece of code that allows us to measure the performance of our Facebook and Instagram advertising, build audiences for future advertising, and show you more relevant ads. Data collected by the Pixel (such as pages visited and actions taken) is shared with Meta and processed in accordance with Meta's privacy policy.
  • Analytics tools: which help us understand how visitors use our website so we can improve it.

You can control or delete cookies through your browser settings, and you can manage your ad preferences with Meta at facebook.com/adpreferences. Disabling cookies may affect some website functionality.

5. Marketing Communications

Where you have requested information from us (such as a free audit) or otherwise consented, we may send you marketing communications about our services by email, phone, SMS, or WhatsApp. We comply with applicable marketing laws, including the Australian Spam Act 2003 (Cth).

You can opt out of marketing communications at any time by clicking the unsubscribe link in any of our emails, replying "STOP" to messages, or contacting us using the details in Section 10. Opting out of marketing will not affect communications that are necessary to deliver a service you have requested.

6. How We Use Your Data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.
  • Where you have requested a service from us, such as a free audit, report, or consultation.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where you have given consent, such as for marketing communications.
  • Where we need to comply with a legal obligation.

7. Sharing Your Data and International Transfers

We may share your personal data with trusted third-party service providers who assist us in operating our business, including:

  • Advertising platforms (such as Meta) for ad delivery and measurement;
  • Email and communication service providers used to send you the information you requested and manage follow-up;
  • Customer relationship management (CRM), hosting, and analytics providers.

These providers are only permitted to process your data on our instructions and for the purposes described in this policy. We do not sell your personal data.

As we operate internationally, your data may be stored or processed in countries outside your own, including countries outside Australia, the UK, and the European Economic Area. Where we transfer data internationally, we take reasonable steps to ensure it receives an adequate level of protection consistent with this policy and applicable law.

8. Data Security and Retention

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors, and other third parties who have a business need to know.

We retain personal data only for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Lead data that does not result in an ongoing business relationship is periodically reviewed and deleted.

9. Your Legal Rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data, including the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data, and (where the lawful ground of processing is consent) to withdraw consent.

If you are in Australia, you also have the right to complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au if you believe we have mishandled your personal information. We would, however, appreciate the chance to address your concerns first, so please contact us in the first instance.
